Affiliate Program Agreement
This Affiliate Program Agreement (“Agreement”) is entered into between Selfy Stick LLC (“Company,” “we,” “us,” or “our”) and you (“Affiliate,” “you,” or “your”). By applying to or participating in our Affiliate Program, you agree to be bound by this Agreement.
1. PROGRAM OVERVIEW
The Selfy Stick Affiliate Program allows approved affiliates to earn commissions by promoting our products and referring customers to our website. Upon acceptance into the program, you will receive a unique affiliate tracking link and optional discount code to share with your audience.
2. COMMISSION STRUCTURE
–Commission Rate: You will earn 15% commission on all qualifying sales made through your unique affiliate link.
–Cookie Duration: Our tracking cookie lasts 45 days. You will receive credit for any purchase made within 45 days of a customer clicking your affiliate link.
–Qualifying Sales: Commissions are calculated on the product sale price after any discount codes are applied, excluding shipping costs and taxes.
–Discount Codes: You may receive a personalized discount code (typically 10% off) to share with your audience. You will still earn your full 15% commission on sales using your discount code.
3. PAYMENT TERMS
Payment Schedule: Commissions are paid weekly, every Friday.
Minimum Payout: A minimum balance of $20 is required for payout. Balances below $20 will roll over to the next payment period.
Payment Methods: We offer payment via PayPal, Venmo, Zelle, direct bank transfer, or store credit.
Tax Responsibility: You are responsible for reporting and paying any applicable taxes on your affiliate earnings. Affiliates earning $600 or more annually may receive a 1099 form.
4. COMMISSION REVERSALS
Commissions may be reversed or withheld in the following circumstances:
- The customer returns the product or requests a refund
- The order is cancelled before shipment
- The transaction is identified as fraudulent
- A chargeback is initiated by the customer
- The sale was made through prohibited marketing methods
5. AFFILIATE RESPONSIBILITIES AND CONDUCT
5.1 FTC Disclosure Requirements
You must clearly disclose your affiliate relationship with Selfy Stick LLC in accordance with Federal Trade Commission (FTC) guidelines. This disclosure must be clear, conspicuous, and placed near any affiliate links or promotional content. Examples of acceptable disclosures include: “Affiliate link,” “I earn a commission if you purchase through my link,” or “#ad #affiliate.”
5.2 Permitted Marketing Activities
- Sharing affiliate links on your personal website, blog, or social media accounts
- Creating honest reviews and demonstrations of our products
- Using approved marketing materials and product images
- Email marketing to your own opt-in subscriber list
5.3 Prohibited Marketing Activities
The following activities are strictly prohibited and may result in immediate termination and forfeiture of commissions:
Inappropriate Content: Promoting our products on websites containing illegal, violent, hateful, or adult content
Spam: Sending unsolicited emails, messages, or communications
Trademark Bidding: Bidding on “Selfy Stick,” “SelfyStick,” or variations thereof in paid search advertising (Google Ads, Bing Ads, etc.)
False Claims: Making medical, legal, or safety claims not explicitly stated by Selfy Stick LLC
Misleading Content: Creating fake reviews, testimonials, or misleading promotional content
Cookie Stuffing: Placing cookies without user knowledge or consent
Incentivized Clicks: Offering rewards for clicking affiliate links without intent to purchase
Self-Referrals: Using your own affiliate link for personal purchases
6. INTELLECTUAL PROPERTY
We grant you a limited, non-exclusive, non-transferable license to use our approved logos, product images, and marketing materials solely for promoting our products as an affiliate. You may not modify our trademarks or create derivative works. All intellectual property rights remain with Selfy Stick LLC. This license terminates immediately upon termination of your affiliate status.
7. PRODUCT SAMPLES
Approved affiliates may receive complimentary product samples (one 6″ and one 8″ Selfy Stick) for review and demonstration purposes. These samples are provided at no cost and remain your property. We reserve the right to limit or decline sample requests at our discretion.
8. TERM AND TERMINATION
- Term: This Agreement begins upon your acceptance into the program and continues until terminated.
- Termination by Either Party: Either party may terminate this Agreement with 30 days written notice.
- Immediate Termination: We may terminate this Agreement immediately without notice if you violate any terms of this Agreement.
- Effect of Termination: Upon termination, you must immediately cease using all affiliate links, discount codes, and Selfy Stick marketing materials. Pending commissions meeting the minimum payout threshold will be paid within 30 days, provided no violations occurred.
9. RELATIONSHIP OF PARTIES
You are an independent contractor and not an employee, agent, partner, or joint venturer of Selfy Stick LLC. You have no authority to bind, commit, or make representations on behalf of Selfy Stick LLC. Nothing in this Agreement creates an employment relationship, and you are solely responsible for your own taxes, insurance, and business expenses.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFY STICK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE AFFILIATE PROGRAM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE SIX MONTHS PRECEDING ANY CLAIM.
11. INDEMNIFICATION
You agree to indemnify and hold harmless Selfy Stick LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your marketing activities, violation of this Agreement, or infringement of any third-party rights.
12. MODIFICATIONS
We reserve the right to modify this Agreement, commission rates, cookie duration, or any program terms at any time. Material changes will be communicated via email or through your affiliate dashboard. Continued participation in the program after changes constitutes acceptance of the modified terms.
13. GOVERNING LAW
This Agreement shall be governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in Riverside County, California.
14. ENTIRE AGREEMENT
This Agreement, together with our website Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and Selfy Stick LLC regarding the Affiliate Program and supersedes all prior agreements or communications.

ACKNOWLEDGMENT
By applying to the Selfy Stick Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement.
