3. PRODUCT INFORMATION AND AVAILABILITY

We manufacture and sell tactical self-defense tools including our signature 6″ aluminum model and 8″ stainless steel model Selfy Stick, along with a variety of branded accessories and merchandise including books, coffee mugs, coasters, t-shirts, sweatshirts, and other lifestyle products.

IMPORTANT: Our Selfy Stick products are designed as self-defense tools and are not toys. They are intended for personal protection purposes only and should be used responsibly and legally.

All product specifications, descriptions, and images on our website are provided for informational purposes. While we strive for accuracy, we reserve the right to correct any errors in product information, pricing, or availability without prior notice.

Product availability is subject to change. We reserve the right to discontinue products, limit quantities, or refuse orders at our sole discretion. All sales are subject to product availability and our acceptance of your order.

4. AGE REQUIREMENTS AND ELIGIBILITY

You must be at least 18 years of age to purchase our products. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Prohibited Purchasers

The following individuals are strictly prohibited from purchasing our products:

Convicted felons (where prohibited by law)
Individuals subject to restraining orders or court orders prohibiting weapon possession
Individuals prohibited by federal, state, or local law from purchasing or possessing self-defense items
Individuals purchasing on behalf of prohibited persons

You are not prohibited by any federal, state, or local law from purchasing self-defense products

5. ORDERS AND PRICING

5.1 Order Process

When you place an order, you are making an offer to purchase our products. We reserve the right to accept or decline your order for any reason, including but not limited to concerns about legal compliance, age verification, or suspected fraudulent activity. Order confirmation does not guarantee acceptance; acceptance occurs when we ship your order.

5.2 Age and Legal Verification

We reserve the right to request age verification and legal compliance documentation before processing any order. Some items on our website may be restricted or illegal in certain areas for possession by those under 18 years of age. Failure to provide requested verification may result in order cancellation.

5.3 Address Verification and Fraud Prevention

Orders with separate billing and shipping addresses are subject to additional verification. We may contact you for verification, and if no contact can be made, your order will be cancelled. This policy protects our customers from fraud and theft. Orders that cannot be authenticated for validity will be cancelled.

5.4 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price displayed at the time of order placement. Applicable taxes and shipping charges will be added to your order total.

5.5 Payment

Payment is due at the time of order placement. We accept Visa, MasterCard, Discover, and American Express. By providing payment information, you authorize us to charge the applicable amount for your order. Payment failures may occur due to fraud detection systems, incorrect billing addresses, or insufficient funds.

6. SHIPPING AND DELIVERY

We ship within the United States and internationally to select countries including the Canada, Netherlands, and Australia using USPS. We process orders within 24-48 hours of receipt.

Domestic Shipping (USA): Standard shipping typically takes 5-7 business days, with expedited options available for faster delivery.

International Shipping: Delivery times vary by destination and service selected. Estimated timeframes will be displayed at checkout based on your location and chosen shipping method. Typical delivery times range from 6-21 business days depending on the service selected.

International Orders: Orders shipped outside the United States may be subject to import duties, taxes, customs fees, and VAT upon arrival. These fees are collected by the carrier or customs at delivery and are the sole responsibility of the customer. We are unable to predict or control these charges. All international orders are final sale and cannot be returned.

Important Shipping Restrictions:

We do not ship to P.O. Boxes for self-defense products
Delivery to someone other than the purchaser may be refused
Adult signature may be required for delivery
We reserve the right to refuse shipment to certain jurisdictions where our products may be restricted
International availability is subject to change based on carrier services and local regulations

Shipping costs are calculated based on your location, package weight, and selected shipping method. All shipping costs will be displayed during checkout before you complete your purchase.

Title and risk of loss pass to you upon delivery to the shipping address you provide. We are not responsible for delays caused by shipping carriers, customs processing, weather, or other circumstances beyond our control. Delivery times are estimates only and not guaranteed.

7. RETURNS, EXCHANGES, AND WARRANTY

7.1 Return Policy

Returns are welcome within 30 days of purchase for non-self-defense merchandise only. Self-defense products (Selfy Stick models) are final sale and cannot be returned for hygiene, safety, and legal reasons. To be eligible for return, items must be in their original condition, unused, and in original packaging. Customer is responsible for return shipping costs.

International Orders: Due to the complexity and cost of international shipping, all orders shipped outside the United States are final sale and cannot be returned or exchanged.

7.2 Exchanges

Product exchanges for self-defense items are not permitted. Exchanges for other merchandise are accepted within 30 days of purchase, subject to the same conditions as returns. International orders are not eligible for exchanges.

7.3 Warranty

Our products come with a limited warranty against manufacturing defects for a period of one year from purchase date. This warranty does not cover:

Damage from normal wear and tear
Misuse, abuse, or improper use
Modifications or alterations
Damage resulting from use in self-defense situations
Damage from improper storage or environmental factors

7.4 Defective Products

If you receive a defective self-defense product, contact our support team within 7 days of delivery with your order information and description of the defect. We will evaluate each case individually.

The use of our self-defense products entails both known and unknown risks that could result in serious bodily injury, partial and/or total disability, paralysis or death. The social and economic losses and/or damages which could result from these risks and dangers may be significant. These risks and dangers may be caused by your action, inaction, negligence, or the actions of any third party.

Selfy Stick LLC is not responsible for any physical harm, property damage, legal consequences, or other damages resulting from the use, misuse, or mere possession of our products. This includes but is not limited to:

Personal injury to yourself or others
Property damage
Legal fees, fines, or penalties
Criminal charges or civil liability
Confiscation of products by authorities
Failure of product to function as expected during an emergency
Any illegal acts committed using our products

8.2 Assumption of Risk and Waiver

By purchasing any self-defense product from us, you:

Acknowledge that self-defense products can cause serious injury or death
Assume full responsibility for determining the legality of purchase, possession, and use in your jurisdiction
Agree that you are solely responsible for proper training and safe handling
Waive any claims against Selfy Stick LLC for damages resulting from your use of our products
Agree to defend and indemnify Selfy Stick LLC against any claims arising from your use of our products

You warrant that:

8.5 Product Misuse and Unforeseeable Use

Our products are designed solely for lawful self-defense by properly trained adults. Any use outside of lawful self-defense constitutes misuse and voids all protections under these Terms.

Misuse includes but is not limited to:

Use in the commission of a crime
Use against law enforcement officers
Use in prohibited locations
Use while under the influence of drugs or alcohol
Use without proper training or knowledge
Use in situations where retreat was safely possible
Excessive force beyond what is legally justified
Use as a weapon of intimidation or aggression

Important: Even in lawful self-defense situations, outcomes can vary significantly based on circumstances beyond our control, including but not limited to user skill, physical condition, stress levels, environmental factors, and the actions of third parties.

8.6 Training and Proper Use Requirements

You acknowledge that:

Proper training is essential for safe and effective use of self-defense products
You are solely responsible for obtaining appropriate training before using our products
Improper use can result in serious injury, death, or legal consequences
Our products are tools only and are not substitutes for avoiding dangerous situations
You should consult a licensed medical professional before using any self-defense products if you have any health conditions
Our products and any related information are for educational purposes only and should not be relied upon for accuracy when dealing with legal matters
You should always consult a lawyer who understands your local laws before purchasing and especially before using our products in any self-defense situation

8.7 No Guarantee of Effectiveness or Outcome

CRITICAL WARNING: We make absolutely no warranty, representation, or guarantee regarding:

The effectiveness of our products in any particular situation
The outcome of any self-defense encounter
The legal consequences of using our products
Your ability to successfully defend yourself
The prevention of injury, death, or property damage
The legal justification for use in any specific circumstance

Effectiveness and outcomes depend entirely upon factors beyond our control including but not limited to user training, physical capability, mental state, environmental conditions, the nature of the threat, local laws, and countless other variables.

9. PROHIBITED USES AND CONDUCT

You agree not to use our website or products for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited uses include but are not limited to:

Violating any applicable laws or regulations
Using products to commit crimes or threaten others
Selling or transferring products to prohibited persons
Removing or altering product markings or serial numbers
Using products in prohibited locations (schools, government buildings, etc.)
Infringing on intellectual property rights
Transmitting viruses or malicious code to our website
Attempting to gain unauthorized access to our systems
Providing false information during purchase
Purchasing on behalf of prohibited persons

SELFY STICK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, DATA, OR USE
PERSONAL INJURY OR PROPERTY DAMAGE
LEGAL FEES OR PENALTIES
BUSINESS INTERRUPTION
LOSS OF PRIVACY OR SECURITY

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

13.3 No Guarantee of Effectiveness

We make no warranty or guarantee that our products will be effective in any particular self-defense situation. Effectiveness depends on numerous factors beyond our control including user skill, circumstances, and product condition.

15. DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. However, specific state laws regarding self-defense products shall apply to residents of those respective states.

15.2 Jurisdiction and Venue

Any disputes arising from these Terms or your use of our products shall be resolved exclusively in the state or federal courts located in Riverside County, California. You consent to the personal jurisdiction of these courts and waive any objection to venue.

15.3 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your purchase of our products shall be settled by binding arbitration administered by JAMS in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Riverside County, California.

15.4 Class Action Waiver

You agree that any arbitration or legal proceeding shall be limited to the dispute between you and Selfy Stick LLC individually. You waive any right to participate in any class action, collective action, or representative proceeding.

16. INTELLECTUAL PROPERTY

All content on our website, including text, graphics, logos, images, designs, and software, is the property of Selfy Stick LLC and is protected by copyright, trademark, and other intellectual property laws. The SELFY-STICK name and logo are trademarks of Selfy Stick LLC.

You may not copy, reproduce, distribute, modify, or create derivative works of our content without our express written permission.

17. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or changes in law that affect our ability to sell or ship products.
